Практика Норвегии и Договор о Шпицбергене (современные международно-правовые вопросы)

Аннотация
Автор проводит обзор основных международно-правовых мер, предпринятых Норвегией в обход норм Договора о Шпицбергене от 9 февраля 1920 г. (далее - «Договор 1920 г.) с 1977 г. по настоящее время и их значение для пространственного расширения пределов действия суверенных прав Норвегии в Арктике. Отмечается, что в своей политике Норвегия исходит из ограничительного толкования Договора 1920 г. и подмены созданного им специального международно-правового статуса архипелага Шпицберген нормами Конвенции ООН по морскому праву 1982 г. В этой связи анализируется зарубежная доктрина, прецедентные решения, которые указывают на недопустимость безоговорочного применения ограничительного подхода при толковании международного договора, без учета его объекта и целей. В статье рассматривается «альтернативная» правовая позиция Норвегии, заключающаяся в том, что суверенитет Норвегии над Шпицбергеном возник и действует на основе норм обычного права; на основе юридических и фактологических доводов обосновывается несостоятельность и данной позиции. В работе делается вывод о том, что применимые источники международного права подвергают сомнению правомерность предпринимаемых Норвегией мер, в силу чего правовая линия Норвегии нуждается в сущностном дополнении и утверждении.
