Уникальность СЕПА заключается в том, что участниками этого международно-правового соглашения являются особый административный район КНР, обладающий широкой автономией, и непосредственно сама Китайская Народная Республика. В данном документе, подчиненном правилам и принципам ВТО, обе стороны выступают как равноправные субъекты международного экономического права. СЕПА содержит многочисленные положения, предусматривающие либерализацию двусторонней торговли товарами и услугами, а также положения о сотрудничестве в различных сферах экономической деятельности. Обязательства сторон СЕПА по либерализации порой превосходят обязательства, принятые ими в рамках ВТО. СЕПА в целом отвечает основным требованиям, предъявляемым к региональным торговым соглашениям (РТС) статьями XXIV ГАТТ и V ГАТС. Договоренность о более тесном экономическом партнерстве знаменует новый подход КНР к РТС. В настоящее время Китай использует РТС для «нейтрализации» слишком жестких и дискриминационных, по его мнению, условий членства в ВТО, которые он вынужден был принять при вступлении в эту организацию.</p></abstract><trans-abstract xml:lang="en"><p>Mainland and Hong Kong Closer Economic Partnership Arrangement (CEPA), singed between the People’s Republic of China and Hong Kong in late 2003, became the first ever free trade deal for the both parties. CEPA is an international agreement, subjected to international (WTO) law, between the central government of China and the government of one of the China’s special administrative regions. This distinguishes the Arrangement from a myriad of other regional trade agreements (RTA). CEPA focuses on liberalization of trade in goods and services between China and Hong Kong. The Arrangement generally complies with relevant WTO provisions and covers areas of trade not governed by WTO agreements (WTO-plus). Moreover, in some respects CEPA goes far beyond trade liberalization agenda of many RTAs.
