В отечественной науке международного права институт amicus curiae является одним из наименее исследованных, в то время как за рубежом на протяжении последних десятилетий ему посвящаются как комплексные исследования, так и публикации, затрагивающие отдельные его аспекты. Частота его использования и характер влияния на международное судебное и квазисудебное производство варьируются среди отраслей международного права. В данной статье рассматривается одна из функций amicus curiae в международном уголовном судопроизводстве – информативная.</p></sec><sec><title>МАТЕРИАЛЫ И МЕТОДЫ</title><p>МАТЕРИАЛЫ И МЕТОДЫ. Статья написана с опорой на существующий объем научного знания в таких отраслях международного права, как право международных договоров, международное уголовное право, право международных организаций, право прав человека, международное экономическое право, история международного права и др. В связи с невысокой степенью разработанности темы в отечественной литературе в исследовании использовались выводы и заключения, сделанные преимущественно в зарубежной доктрине международного права, включая публикации текущего года. Эмпирическую основу исследования составили международно-правовые акты, внутренние акты органов международного уголовного судопроизводства, материалы производств по рассмотрению межгосударственных споров, консультативных производств, материалы практики международных уголовных судов. Использованная методология является комбинацией общенаучных методов познания (методы анализа и синтеза, индукции и дедукции, критический и диалектический) и частных научных методов, характерных для юридических наук (историко-правовой, сравнительно-правовой).</p></sec><sec><title>РЕЗУЛЬТАТЫ ИССЛЕДОВАНИЯ</title><p>РЕЗУЛЬТАТЫ ИССЛЕДОВАНИЯ. Международные уголовные суды активно используют межотраслевой механизм amicus curiae для получения информации как правового, так и фактологического характера по вопросам, подлежащим разрешению в ходе уголовного производства. Допуск amicus curiae к участию в международном уголовном процессе целиком и полностью зависит от судейского усмотрения. В качестве amicus curiae на практике выступают как субъекты международного права, так и международные неправительственные организации, физические и юридические лица, профессиональные объединения.</p></sec><sec><title>ОБСУЖДЕНИЕ И ВЫВОДЫ</title><p>ОБСУЖДЕНИЕ И ВЫВОДЫ. Чересчур частое использование механизма amicus curiae представляется трудносовместимым с максимой iura novit curia. Современная практика его применения представляет собой благодатную почву для всякого рода злоупотреблений и нуждается в пересмотре. В частности, в соответствующей части поучительным мог бы быть опыт Международного суда ООН, Международного трибунала по морскому праву, Комиссии ООН по праву международной торговли. </p></sec></abstract><trans-abstract xml:lang="en"><sec><title>INTRODUCTION</title><p>INTRODUCTION. While abroad over the past decades both comprehensive research and publications touching on individual aspects of amicus curiae in international law have been edited, it garnered only very little scholarly attention in Russian scientific literature. The frequency of its use and the nature of its impact on international judicial and quasi-judicial proceedings vary among branches of international law. This article considers one of the functions that an amicus curiae may perform in international criminal proceedings – the function of expertise.</p></sec><sec><title>MATERIALS AND METHODS</title><p>MATERIALS AND METHODS. The article is based on the existing volume of scientific knowledge in different branches of international law, such as law of international treaties, international criminal law, law of international organizations, human rights law, international economic law, history of international law and others. The research is based on the conclusions and inferences achieved mainly in the foreign doctrine of international law including publications of this year, due to the low degree of development of the topic in Russian literature. The empirical basis of the research is formed by international legal acts, internal acts of international criminal tribunals, materials of proceedings relating to interstate disputes, international advisory proceedings, practice of international criminal courts. The methodology used is a combination of general scientific methods of cognition (methods of analysis and synthesis, induction and deduction, critical and dialectical) and private scientific methods typical for legal sciences (historical, comparative).</p></sec><sec><title>RESEARCH RESULTS</title><p>RESEARCH RESULTS. International criminal courts actively rely on the amicus curiae mechanism to obtain information, both legal and factual, on issues under consideration in criminal proceedings. The admission of amicus curiae to international criminal proceedings is entirely at the discretion of the judiciary. In practice, amicus curiae applications are submitted by subjects of international law, international non-governmental organizations, natural and legal persons and professional associations.</p><p>DISCUSSION AND CONCLUSIONS. Too frequent use of amicus curiae mechanism seems to be difficult to reconcile with the iura novit curia maxima. Its current practice provides fertile ground for all kinds of abuse and needs to be reviewed.
