Принцип jura novit arbiter или jura novit tribunus представляет собой проекцию доктрины jura novit curia на международные арбитражные разбирательства, свободную от особенностей национального законодательства. Значение применения этого принципа заключается в возможности третейского суда принимать участие в установлении содержания применимых норм права. С учетом особенностей международного арбитража jura novit arbiter существенно ограничивается в целях защиты интересов спорящих сторон. Однако подобное ограничение имеет как положительные, так и отрицательные правовые последствия.</p></sec><sec><title>МАТЕРИАЛЫ И МЕТОДЫ</title><p>МАТЕРИАЛЫ И МЕТОДЫ. В качестве материалов для исследования были использованы международные договоры, регулирующие установление содержания применимого права, практика международного коммерческого и инвестиционного арбитражей, демонстрирующая способы установления пределов свободного усмотрения третейского суда и соответствующие последствия ограничения принципа jura novit arbiter, а также труды российских и зарубежных ученых. Методологическую основу исследования составляют общенаучные и специально-юридические методы.</p></sec><sec><title>РЕЗУЛЬТАТЫ ИССЛЕДОВАНИЯ</title><p>РЕЗУЛЬТАТЫ ИССЛЕДОВАНИЯ. В исследовании проводится анализ применения принципа jura novit arbiter в международном арбитраже, который позволяет авторам представить классификацию основных ограничений его действия. В статье приводятся практические примеры взаимодействия принципа jura novit arbiter с отдельными видами институтов, направленных на сужение сфер его применения.</p></sec><sec><title>ОБСУЖДЕНИЕ И ВЫВОДЫ</title><p>ОБСУЖДЕНИЕ И ВЫВОДЫ. Исследование вопроса позволило авторам сделать следующие выводы. Во-первых, существуют три основных ограничителя свободного усмотрения арбитров:  1) принцип запрета выхода за пределы запрошенных сторонами средств правовой защиты (далее – ne ultra petita), 2) требование о ведении надлежащего арбитражного разбирательства в части права быть услышанным и связанного с ним критерия «предвидимости» (далее – due process), 3) обеспечение скорости и эффективности арбитражного разбирательства (далее – expediency and efficiency). Во-вторых, ограничение принципа не всегда приводит к ожидаемым результатам: с одной стороны, оно направлено на обеспечение правовой определенности и предсказуемости арбитражного разбирательства и его результатов, обеспечение прав и интересов сторон. С другой стороны, указанные ограничения на практике обнаруживают ряд недостатков: отсутствуют заранее определенные условия исключения применения принципа ne ultra petita, категория «предвидимости» носит оценочный характер, а нарушение баланса между expediency and efficiency и jura novit arbiter влияет на корректность применения и толкования норм права.</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>INTRODUCTION</title><p>INTRODUCTION. The principle of jura novit arbiter or jura novit tribunus is an analogue of the doctrine of jura novit curia in international arbitration proceedings which is free from the peculiarities of national laws. The significance of its application in international arbitration lies in the powers of an arbitral tribunal to participate in ascertaining the content of the applicable law. Given the features of international arbitration, material limitations are put on the jura novit arbiter principle in order to protect the rights and interests of disputing parties. However, limitations have both positive and negative legal effects.</p></sec><sec><title>MATERIALS AND METHODS</title><p>MATERIALS AND METHODS. The authors researched the provisions of international treaties, case law of tribunals and state courts demonstrating the scope of the arbitrator’s discretionary powers and the effects of its limitation, as well as the works of Russian and foreign scholars. The methodological basis of the research includes general scientific and special methods.</p></sec><sec><title>RESEARCH RESULTS</title><p>RESEARCH RESULTS. The analyses of international treaties and case law led to the elaboration of the list of the main limits of the jura novit arbiter application. The study examined the issues in the relationship between jura novit arbiter and other principles aimed at narrowing the scope of its functioning.</p><p>DISCUSSION AND CONCLUSIONS. The results of the analysis allow to draw the following conclusions. First, there are three major constraints put on the arbitrators' discretion: 1) ne ultra petita (not beyond the request), 2) due process in terms of a right to be heard and the foreseeability test, 3) expediency and efficiency of arbitral proceedings. Secondly, the limitation of the principle is a double-edged sword: on the one hand, it ensures legal certainty and predictability of an arbitral proceeding and its outcome, secures the rights and interests of the parties.
