   ВВЕДЕНИЕ. В разное время рациональному использованию морских живых ресурсов в районах открытого моря наносился ущерб вследствие нерегулируемых рыбных промыслов. В связи с потеплением климата угроза нерегулируемого рыбного промысла обозначилась и в отношении открытого моря в центральной части Северного Ледовитого океана. В результате многораундовых переговоров 3 октября 2018 г. в г. Илуллиссате (Гренландия, Дания) в так называемом формате «пять плюс пять» – представителями пяти прибрежных приарктических (Россия, США, Канада, Норвегия, Дания) государств и четырех неарктических (КНР, Япония, Южная Корея, Исландия), а также Европейского союза, было подписано Соглашение о предотвращении нерегулируемого промысла в открытом море в центральной части Северного Ледовитого океана (Agreement to Prevent Unregulated High Seas Fisheries in the Central Arctic Ocean; далее также – Соглашение 2018 г.). В этом новом международно-правовом документе отражены национальные интересы в оптимальном использовании морских живых ресурсов не только названных пяти приарктических государств, но и местных жителей Арктики, в т. ч. коренных малочисленных северных народов, а также тех государств, которые проявили практический интерес к ведению здесь рыболовства.

   МАТЕРИАЛЫ И МЕТОДЫ

   МАТЕРИАЛЫ И МЕТОДЫ. В статье показана эволюция международно-правовых мер по предотвращению нерегулируемого рыбного промысла в районах открытого моря. Особое внимание уделено исследованию нормативных и научно-аналитических материалов, раскрывающих договорную практику государств по управлению рыбным промыслом в анклавах окраинных морей Северного Ледовитого океана. Также дано юридическое толкование положений Соглашения 2018 г. При проведении исследования авторами использовались исторический, сравнительно-правовой и некоторые другие общенаучные и специальные юридические методы.   РЕЗУЛЬТАТЫ ИССЛЕДОВАНИЯ. В рамках работы обосновано утверждение о том, что с международно-правовой точки зрения Соглашение 2018 г. представляет собой инновационный международный договор в смысле Венских конвенций о международных договорах 1969 и 1986 гг., в котором отражены интересы не только приарктических, но и неарктических государств. И, несмотря на обеспокоенность по поводу участия последних в нём (прежде всего, Китая) со стороны западных государств, Соглашение, тем не менее, было ратифицировано до начала возможного промышленного рыбного промысла в открытом море в центральной части Северного Ледовитого океана. Это позволяет заблаговременно не допустить развития нерегулируемого рыбного промысла и, тем самым, предотвратить истощение морских живых ресурсов в этой части Северного Ледовитого океана, в отличие от некоторых других анклавов открытого моря.   ОБСУЖДЕНИЕ И ВЫВОДЫ. Вступление в силу Соглашения 2018 г. ознаменовало начало сотрудничества заинтересованных государств по предотвращению нерегулируемого рыбного промысла в центральной части Северного Ледовитого океана. Помимо реализации основной цели, научное сотрудничество между Сторонами будет способствовать более глубокому исследованию огромного по размерам, одновременно наименее изученного района открытого моря, окруженного зонами юрисдикции прибрежных государств. Ожидается, что в будущем спектр рассматриваемых природоохранных вопросов в центральной части Северного Ледовитого океана расширится.

   INTRODUCTION. At various times, the sustainable use of marine living resources in the high seas outside exclusive economic zones, as well as in areas under the jurisdiction of Arctic coastal states, has been severely damaged by illegal, unregulated and unreported fishing. As the climate warms, the threat of unregulated fishing has also emerged on the high seas in the Central Arctic Ocean. As a result of multi-round negotiations on October 3, 2018 in Ilullissat (Greenland, Denmark) in the so-called «five plus five» format – representatives of five Arctic and four non-Arctic states, as well as the European Union, the Agreement to Prevent Unregulated High Seas Fishing in the Central Arctic Ocean was signed. This new international legal document reflects national interests in the optimal use of marine living resources of the Arctic states, the Arctic indigenous peoples and residents, as well as interested states.   MATERIALS AND METHODS. The article shows the evolution of international legal instruments to prevent illegal, unregulated and unreported fishing in the high seas. Particular attention is paid to the study of normative and doctrinal materials revealing the treaty practice of states in the Arctic enclaves. The legal interpretation of the provisions of the 2018 Agreement is also given. In the study the authors used historical, comparative-legal and some other general scientific and special legal methods.   RESEARCH RESULTS. From an international perspective, the 2018 Agreement is an innovative legal document that reflects the interests of not only the Arctic states but also non-Arctic states. Despite concerns about the participation of the latter (China, in particular)on the part of Western states, the Agreement was nevertheless signed and ratified before possiblecommercial fishing on the high seas in the Central Arctic Ocean starts. This would prevent illegal, unregulated and unreported fishing in advance and thus prevent the depletion of marine living resources in this part of the Arctic Ocean, unlike it happened in other enclaves of the high seas in the Northern Hemisphere.   DISCUSSION AND CONCLUSIONS. The entry into force of the 2018 Agreement marked the beginning of cooperation among interested states in prevention of unregulated high seas fishing in the Central Arctic Ocean. Besides the general purpose of the Agreement, scientific cooperation between the Parties will contribute to better understandingof the least-explored area of the high seas. It is likely that the environmental cooperation in the Central Arctic Ocean will expand considerably in the future.
