Продвигаются идеи специальных правовых режимов и инструментов, одним из которых являются односторонние ограничительные меры, практика применения которых получает все большее распространение. Страной, наиболее активно использующей этот инструмент в своих внешнеполитических целях, являются США. В публицистике и американской доктрине произошло практически полное отождествление понятий «односторонние ограничительные меры» и «санкции», что представляется ошибочным. В течение своей истории США неоднократно прибегали к использованию односторонних рестрикций. В американском законодательстве предусмотрены два правовых основания их применения - при объявлении чрезвычайного положения или без такого. Первый способ имплементируется, как правило, на основании указа Президента США. При этом критерии признания ситуации «чрезвычайной и угрожающей национальным интересам» размыты, что создает широкие возможности для злоупотребления полномочием. Антироссийские «санкции» в 2014 г. также были введены из-за признания действий Москвы угрожающими безопасности США. Охват действия американских «санкций», которые в основном имеют торгово-экономическую направленность, достаточно широк. Эффективность американских рестрикций неочевидна. Однако в сочетании с другими внешнеполитическими инструментами они могут давать желаемый результат.</p></abstract><trans-abstract xml:lang="en"><p>States apply unilateral restrictive measures with increasing frequency. The United States is a country that uses such measures most actively for its foreign policy purposes. In American legal doctrine term “unilateral restrictive measures” is often mistakenly identified with term “sanctions. American Law provides for two reasons for “sanctions” application – while declaring national emergency and without that. The first one is most frequently used and applied – as a rule – on the basis of President’s Order. Criteria for acknowledging certain situation “extraordinary and threatening to US interests” are vague thus creating broad opportunities for power abuse. Sanctions against Russia were enforced in 2014 after Moscow’s actions were construed as threatening to US security. The question of unilateral sanctions’ legality is highly controversial. Exterritorial character of certain US restrictions is especially criticized. Effectiveness of American restrictions is not obvious.
